We reserve the right to periodically update our Site, including changing its content. Please be aware that certain information on our Site might become outdated, and there is no obligation on our part to update it.
Our Site and its content might contain errors or omissions, and we do not guarantee their absence.

6. Definitions

"Users" refers to any individuals, businesses or organisations who use our site (where "use" includes accessing, browsing, or registering for site use);
“Services” means features on our Site which enable Users who have available accommodation and are in search of a tenant or co-tenant to create a listing for their rental properties by uploading content and Users who are in search of rental accommodation to create a listing for their requirements by uploading content;
“Listing” means an online ad/advertisement that registered Users can post on our Site offering available accommodations for rent, or specifying the requirements of the accommodation they are looking for;
“User-Generated Content” means any information, text, images, photos, audio, video, or other materials of any kind that Users, including yourself, upload, post, publish, display, transmit, or otherwise contribute on our Site or share privately with other Users. This includes ads and any content or materials featured within them;
"Intellectual Property Rights" means copyrights, patents, trademarks, service marks, designs, domain names, rights in software and other statutory rights, as well as all common law or equitable rights that safeguard business or personal reputation.

7. Accessing and Registering with our Site

Access to and registering with our Site and posting a listing and an ad are provided free of charge. Exploring certain areas of the Site are accessible without registration, however, to create and post listings and ads on the Site and to contact advertisers, registration and account creation with a valid email address are required. Browsing the Site without registering still falls under these Terms.

We offer users the option to log in to our Site using their Google account details. If you opt to create an account with us linked to your Google profile, you only need to input your Google login details to establish an account. By providing your Google login details, you are authorising us to share specific information with Google and display it on our site, enabling us to offer you an improved service.

Please note we cannot ensure continuous availability or uninterrupted access to our Site. The accessibility of our Site is temporary, and we reserve the right to suspend, withdraw, discontinue, or modify all or part of our Site without prior notice. We hold no liability if our Site becomes unavailable for any duration or at any time.

It's your responsibility to make the necessary arrangements to access our Site. You're also accountable for ensuring that anyone accessing our Site through your internet connection is aware of and complies with these Terms and any other relevant conditions.

8. Your Account Credentials

We reserve the right to deactivate any user ID or password, whether chosen by you or assigned by us, if we reasonably believe you have not complied with these Terms.

The User agrees not to copy, reproduce, or download any information, text, images, video clips, directories, files, databases, or listings available on our Site for the purpose of re-selling or re-distributing our Site content, mass mailing, or any other commercial exploitation without the explicit written permission of Pathseeker Ltd.

10. The Function of our Site

Our Site facilitates users with available accommodation who are seeking tenants or co-tenants to effortlessly create and post listings and ads for their rental properties. Simultaneously, users in search of rental accommodation can create listings detailing their requirements by uploading relevant content.

11. Information Disclaimer

Our Site provides general information and should not be considered as advice to rely upon. It's essential to seek professional or specialised advice before making any decisions based on the content here. While we strive to update our Site's information, we do not assure, represent, or guarantee that the content is entirely accurate, complete, or current.

12. Acknowledgements

You undertake and confirm that:

• You are above the age of eighteen and that the information provided during your registration on our Site is accurate and complete;
• You have not previously been banned by us;
• You do not already have an account registered with us;
• You ensure that any tenancy, license, or lodger arrangements associated with the rental of your property comply with all relevant laws and regulations. Your actions will consistently align with the terms of these arrangements, as well as with the applicable laws and regulations.
• case you're a user intending to post an ad for a property for rent in Scotland, except for live-in landlords seeking a lodger, and even if you're legally allowed to advertise or rent without the following, solely for advertising on this Site, you:
  • hold an active and valid registration in the Scottish Landlords Register, or
  • Have an ongoing application with the relevant fee paid for registration in the Scottish Landlords Register, as long as there hasn't been a prior revocation or refusal of registration.
  (We reserve may request evidence from you regarding the above and seek confirmation from the relevant local authority at any time.)
• In case you are acting as an Agent, you:
  • are a registered company, and
  • hold membership in a government-approved Property Redress Scheme;
• Every ad on our Site includes a public profile of the advertiser. When you post an ad, you agree to include details like your age and gender in your profile. For any profile updates, please contact us at support@roomsavailable.uk.
• These Terms, along with any explicitly mentioned documents, constitute the complete agreement between you and us. They replace and nullify any prior agreements, pledges, assurances, guarantees, warrantees, declarations, or understandings between us, whether verbal or written, relating to their subject matter.
• You do not base your decisions on any statement, affirmation, guarantee, or warranty (whether made innocently or negligently) that is not explicitly outlined in these Terms or any document specifically referenced herein.

13. Prohibited Activities

Our Site is intended solely for lawful purposes without any financial gain. You are prohibited from using our Site:

• In any manner that violates local, national, or international laws or regulations.
• Engaging in any fraudulent or unlawful activity or with any fraudulent or unlawful intent.
• Sending, receiving, uploading, downloading, or reusing material that doesn’t align with our User Generated Content Standards (as described in clause 15 below).
• Transmitting or soliciting unsolicited or unauthorised advertising, promotional materials, or any similar form of solicitation (spam).
• Intentionally transmitting any data or uploading material containing harmful computer programs, such as viruses, trojan horses, worms, or similar elements designed to disrupt computer software or hardware.

You further agree:

• Not to replicate, duplicate, copy, or resell any part of our Site against the Terms outlined here.
• Not to access without proper authorisation, interfere with, damage, or disrupt:
  • Any section of our Site.
  • The equipment or network hosting our Site.
  • The software utilized in providing our Site.
  • Any equipment, network, or software owned or used by any third party.

14. User Generated Content on Our Site

Whenever using a feature for uploading content or connecting with other Users on our Site, adherence to the user generated content standards in clause 18 is mandatory.

By ensuring your contribution aligns with these standards, you warrant its compliance and hold liability, indemnifying us for any breaches. Consumer users are accountable for any resulting loss or damage due to a breach of this warranty.

User generated content on our Site is deemed non-confidential and non-proprietary. While retaining ownership rights, you grant us and other Users a limited license to utilise, copy, translate, publish, distribute, and store such content. Additionally, it may be distributed and made accessible to third parties.

Moreover, we reserve the right to disclose your identity to any third party making claims that your posted or uploaded content on our Site violates their intellectual property rights or right to privacy.

User generated content, whether publicly posted or privately transmitted, remains the sole responsibility of the User originating it. We do not oversee or regulate content uploaded to our Site or privately transmitted by Users. Consequently, we bear no responsibility or liability to any third party for the accuracy, quality, or integrity of such content posted by Users. Your use or reliance on any materials posted on our Site is entirely at your own risk.

The opinions expressed by Users on our Site do not represent our views or principles. Our Site may contain links to third-party websites and resources solely for informational purposes; we do not regulate the content of these external sites or resources. We retain the right to remove any of your postings on our Site if we deem that they do not align with the user generated content standards outlined in clause 18.

The views expressed by other users on our Site do not reflect our own viewpoints or values.

16. Suspension and Termination

We reserve the right to determine any breach of these Terms arising from your use of our Site at our discretion. If you fail to comply with these Terms, it may result in the following actions:

• Immediate, temporary, or permanent withdrawal of your access rights to our Site.
• Immediate, temporary, or permanent removal of any User Content you've uploaded.
• Issuance of a warning.
• Legal actions to reclaim all costs incurred due to the breach, including reasonable administrative and legal costs, on an indemnity basis.
• Further legal steps as required.
• Disclosure of necessary information to law enforcement authorities or any other action as deemed reasonably necessary by us.

If you no longer wish to remain a User of our Site, kindly notify us at support@roomsavailable.uk. Upon such notice, your account details will be deleted from our systems within 60 days. Within the initial 30 days of this period, your account can be reactivated at no charge (though this can be done only once every 24 months). After this initial 30-day period, your account will be marked for deletion, and you won’t be able to post ads and listings. Once deleted, a new and fresh account will be required to resume posting listings and ads.

To terminate your account, a written 30-day notice from your official email or on letterheaded paper is essential.

17. Our Liability

You acknowledge that our Site displays listings and ads, which are posted by registered Users, not by us. While we take reasonable steps to scan posted ads for spam and scams, we don't actively monitor all content on the Site. Therefore, we're not liable for User Generated Content. If you spot inaccurate, inappropriate, or offensive content (or any violation of our Terms) posted by other members, please inform us at support@roomsavailable.uk.

We don't provide guarantees, representations, or warranties, whether explicit or implied, regarding property details, quality and conditions, price or cost, or other information displayed on our Site. Furthermore, we don't endorse or recommend any listing, ad or advertiser listed or accessible through our Site. We won't be held liable to you or anyone else for any decisions made or actions taken based on such information.

We do not conduct inspections on the properties featured in listings and ads, so before selecting a property to rent or making any commitments to the tenant or co-tenant, it's strongly recommended that you conduct your own due diligence, background check, property viewing and inspection. YOU ARE SOLELY RESPONSIBLE FOR CHOOSING YOUR OWN ADVERTISER, TENANT, CO-TENANT and/or PROPERTY.

These Terms do not exclude or limit our liability for death or personal injury resulting from negligence, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Scottish law.

To the extent permitted by law, we disclaim all implied or express conditions, warranties, representations, or other terms that may apply to our Site or its content. We will not be held liable to any User, whether in contract, negligence, breach of statutory duty, or otherwise, even if foreseeable, arising from the use of, or inability to use, our Site; or the reliance upon any listings, ads and user generated content displayed on our Site for any loss or damage, such as:

• Loss of profits, sales, business, or revenue;
• Business interruptions;
• Anticipated savings loss;
• Business opportunity, goodwill, or reputation loss; or
• Any indirect or consequential damage or loss.

We shall not be held liable for any damage or loss caused by a virus, distributed denial-of-service attack, or other technologically harmful materials that might affect your computer equipment, programs, data, or other proprietary material as a result of using our Site or downloading any content from it or any linked website.

18. Third Party Content

You acknowledge and agree that certain content displayed on our Site, such as ds, listings, promotions, photos, videos, logos, banners, and advertising materials, is provided or posted by users or third parties. Any content provided or transmitted by user and third parties, whether publicly posted or privately sent, is solely the responsibility of the originating party or individual. Therefore, the user and third party—not Pathseeker Ltd—is entirely accountable for all content uploaded, posted, or transmitted via the features and services offered by our Site.

We do not exercise control over user and third-party content posted through specific features and services on our Site. Consequently, we do not guarantee the accuracy, integrity, quality, appropriateness, or legality of any user and third-party content and will not be liable to any user relying on such content. Additionally, we disclaim responsibility for any activities conducted by users and third parties on our Site, absolving ourselves from liability for any damages suffered by individuals due to such user and third-party conduct. Although we reserve the right to do so, as a general rule, we do not pre-screen user and third-party content posted on our Site.

Our Site may comprise hyperlinks, such as word links or banners, directing users to websites managed by entities other than Pathseeker Ltd. Users must understand that we do not take responsibility for the usage of these external websites, even if accessed through links on our Site. We neither oversee nor monitor these websites and assume no responsibility or liability for their content, products, services, or information. Moreover, Pathseeker Ltd should not be construed as endorsing or approving the contents of linked websites in any way.

By using the features and services provided on our Site, users acknowledge that they may encounter content that could be offensive, indecent, or objectionable. Pathseeker Ltd will not be liable in any way for any user and third-party content, including errors or omissions within such content or any resultant loss or damage incurred through the use of such content posted, emailed, or transmitted via our Site's features, products, and services.

19. Viruses

We cannot guarantee that our Site will always be secure or free from bugs or viruses.

You are responsible for configuring your own information technology, computer programs, and platform to access our Site. It's important to use your own virus protection software.

Misuse of our Site by intentionally introducing viruses, trojans, worms, logic bombs, or any malicious or technologically harmful material is strictly prohibited. Attempting unauthorised access to our Site, the server it's hosted on, or any connected server, computer, or database is also prohibited. Any attack on our Site, such as a denial-of-service attack or a distributed denial-of-service attack, is forbidden. Such actions constitute a criminal offense under the Computer Misuse Act 1990. We will promptly report any breach to the relevant law enforcement authorities and will fully cooperate by disclosing your identity to them. Your right to use our Site will be terminated immediately upon such a breach.

21. Communications between Us

When we refer to 'in writing' in these Terms, this includes communication via email.

Any notice or communication exchanged between you and us, concerning these Terms, must be in written form and delivered in person, sent through prepaid first-class mail or other next working day delivery service, or via email. A notice or communication will be considered received: if delivered in person, upon reception at our registered office; if sent by prepaid first-class mail or other next working day delivery service, at 9:00 am on the second business day following posting; or if sent by email, one business day after transmission.

For proving the service of any notice,, it is sufficient to prove that a letter was appropriately addressed, stamped, and posted or that an email was sent to the specified email address of the recipient.

This clause's provisions do not apply to serving proceedings or other documents in any legal action.

22 - Other Key Terms

You agree to indemnify and hold us (including our agents, officers, directors, and employees) harmless against any claims, regulatory complaints, costs, proceedings, demands, losses, damages, expenses, or liabilities arising from your breach of these Terms or your use of our Site.

We shall not be held liable to the User for delays or failures in performance or disruptions to the content, features, or services of our Site arising directly or indirectly from events beyond our reasonable control, such as Acts of God, unforeseen forces, or causes, including but not limited to, internet failures, equipment malfunctions, power outages, labour disputes, riots, natural disasters, governmental actions, or court orders.

By using the features and services of our Site, you explicitly understand and agree that it is at your own risk. Unforeseen technical or other difficulties might lead to data loss or service interruptions. Any material or information obtained through our Site is at your own discretion and risk, and you are solely responsible for any resulting damage to your computer system or data loss.

Our failure to enforce any of these Terms or obligations, or our delay in doing so, does not waive our rights against you or excuse your obligations. Any waiver must be in writing, and any default waiver does not automatically waive future defaults.

These Terms and any disputes or claims arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with Scottish law.

Both parties agree that the Scottish courts shall have exclusive jurisdiction to settle any disputes or claims arising from or in connection with these Terms or their subject matter, including non-contractual disputes.
